A. Considerations. For the sum of $XXXXX, Cecilia Bartholet, (hereinafter referred to as seller), agrees to sell and (hereinafter referred to as buyer) agrees to purchase one standard poodle (hereinafter referred to as dog.)
B. Delivery. The dog is to be delivered to buyer on [date month year]. The buyer is responsible for all transportation charges both to and from the seller, and any incidental fees or costs relating to travel.
C. Limited health guarantee. Seller agrees to refund purchase price of puppy upon return to seller if within 72 hours the dog is found to be suffering from communicable illness, attributable to the seller, as determined by a licensed veterinarian and confirmed by lab results. Guarantee will exclude internal and external parasites. Guarantee is limited to the amount of purchase price and does not include incidental expenses or veterinary bills incurred by the buyer. Discovery of the disease within 72 hours of delivery of the puppy by seller to buyer must be documented in writing from the veterinarian, including relevant lab results and testing, and presented to the seller within one week of delivery of the puppy.
D. Genetic health guarantee. In addition, if the dog is diagnosed as having hip dysplasia, sebaceous adenitis, von Willebrand’s disease, thyroid disease, or genetic eye disease prior to five years of age, seller shall at buyer's option, replace dog under terms specified above (buyer pays for transportation and any incidental or veterinary expenses incurred, but not a new dog). Written proof of spaying or neutering of afflicted animal is required before replacement animal is provided. Seller may require OFA (Orthopedic Foundation for Animals) confirmation of hip dysplasia, OFA confirmation of eye problems, and authoritative confirmation of sebaceous adenitis by OFA approved labs and vWD, as well as documentation from any veterinarians and/or lab technicians involved.
E. Buyer’s obligations for responsible pet ownership. Buyer agrees:
1. To give this dog the proper care, nutrition, and shelter necessary to allow the dog to achieve his\her full genetic potential, and,
2. That this dog will carry the seller's kennel prefix, Evening Stars, and will consistently be exhibited in matches and any AKC sanctioned events under such registered name, and,
3. That upon deciding to sell this dog, buyer must notify seller and seller must be given first right of refusal and be allowed to repurchase said dog, and,
4. To provide routine veterinary care as well as care for illness and to assume the costs associated with this obligation, and,
5. To have this dog groomed on a regular basis as required for good health and appearance, and,
6. That this dog will not be offered for sale to pet shops, puppy mills, or their representatives or suppliers or be placed in a shelter.
F. Breeding Prohibitions. The buyer agrees to the following:
1. That neither this dog nor its offspring will be offered for sale to pet shops, puppy mills, or their representatives or suppliers. Progeny of this dog sold as pets must be spayed/neutered and be registered with the American Kennel Club through their limited registration option and ,
2. Buyer agrees not to breed the dog until it has passed the listed genetic tests. If the buyer wishes to breed the dog before it has completed its championship, the breeding must be approved by the seller. The dog may not be used for breeding prior to 2 years of age. Required Genetic tests: Hips, Elbows, Cardiac, Eyes, Neonatal Encephalopathy w/Seizures, Osteochondrodysplasia, Von Willebrands, and Degenerative Myelopathy.
3. The buyer agrees that this dog will never be used for breeding in any way and that if the buyer or his/her agents use this dog for any kind of breeding to include producing cross breeds such as labradoodles or goldendoodles that the buyer will be subject to legal action. If Seller must resort to litigation, the buyer agrees to pay all court costs as well as $25,000.00.
G. Conformation Showing Conditions. Buyer and Seller agree to the following terms for conformation showing of the dog.
1. Buyer agrees that the dog’s AKC registered name will begin with “Evening Stars” and be mutually agreeable to both parties. Seller will be listed as owner with buyer listed as co-owner and the address on the registration will be the buyer’s.
2. Buyer agrees that the dog will be shown to its AKC championship before the dog’s fifth birthday and to assume all costs incurred during the period of its campaign.
3. Should the seller handle the dog for the buyer in AKC, a separate agreement will cover this arrangement.
4. UKC Championship may be considered upon further discussion. A separate agreement will be written up to cover this arrangement.
H. Liability Conditions. The seller's guarantee is null and void if any of the abovementioned conditions are not met, or if there is a change of ownership of this dog. Seller is not responsible for this dog if it has suffered neglect, mistreatment, or exhibits temperament faults that are the result of lack of training, neglect, or abuse by the owner. In addition, seller is not responsible for any damages or bodily harm either directly or indirectly caused by said dog. Legal costs derived from litigation involving this sale or contract will be borne by the buyer.
